The Presidential Election Petition Court (PEPC) has released the 798-page judgment on the petitions filed by Atiku Abubakar, Peter Obi and Allied Peoples Movement against the election of President Bola Ahmed Tinubu.
At its ruling which ran up till 10pm on Wednesday, the court chaired by Justice Hassan Tsammani dismissed the three petitions for lacking material facts and for being unmeritorious.
The Court affirmed Bola Ahmed Tinubu as the duly elected President of the Federal Republic of Nigeria. They however awarded no cost, declaring that parties are to bear their cost.
The APM case was the first to be dismissed. The court said it lacked merit and that the party has no locus standi to bring before the tribunal a pre-election matter.
The court spent more than five hours on Peter Obi and his LP petition, painstakingly demolishing all the prayers canvassed by both petitioners.
According to the unanimous ruling, the LP and its candidate, Mr. Peter Obi were unable to prove that INEC deliberately refused to upload the results on IREV
Petitioners failed to substantiate their evidence that Tinubu is not qualified to run for election for merely being fined the sum of $460,000 in the USA.
It said INEC has the right to conduct election in any manner it deemed fit and cannot be compelled to electronically transmit results.
The court also dismissed LP’s widespread Irregularities claim as baseless and generic.
The Court while highlighting a claim by the respondents said that Obi’s petition only alleged that there were widespread irregularities without giving the particulars and the polling units.
